THE STATE WILL TAKEOVER OF THE SULTAN’s HOTEL LAND, KAPOLRI IS READY TO GUARD

NATIONAL Police Chief (Kapolri), Gen. Listyo Sigit Prabowo confirmed that he would oversee the implementation of the takeover of Hotel Sultan, which is still being managed by Pontjo Sutowo’s PT Indobuildco. The Building Use Rights (HGB) owned by PT Indobuildco are known to have expired in March and April 2023 and their management has been transferred to the Ministry of State Secretariat (Kemensetneg).

“There has been a PK (Court Decision) civil decision that won the state’s favor and then the Minister of ATR has explained that the right to management or HGB has ended and that means that the land will again belong to the state, in this case the state secretariat,” said Listyo at the Coordinating Ministry for Political, Legal and Security Affairs, Jakarta, Friday (9 /08), 2023.

The number one person in the National Police also said that the next step is to take rights over land or state assets. He ensures that he will comply with the regulations in force.

“Of course, the National Police will oversee the process to be carried out to return the state-owned assets or land back to the state,” Listyo said.

In addition, Listyo said that apart from the release of Hotel Sultan, he also suspected that PT Indobuildco had other criminal allegations because the court’s executive decision was not carried out.

“That there was an executive decision that was not implemented by PT Indobuildco and this raised the potential for a new crime. Starting from general criminal matters and those related to corruption laws,” he explained.

The legal counsel for the Management Center for the Bung Karno Gelora Complex (PPKGBK), Chandra Hamzah, emphasized that the Senayan Complex used to be acquired by the state using state funds. Then, PT Indobuildco was granted Building Use Rights by Ali Sadikin as Governor of DKI Jakarta.

“Indobuild’s HGB there is not by acquiring land, it doesn’t cost a penny for land acquisition,” said Chandra.

According to him, the permit was given for 30 years to Indobuildco to use the land and build a hotel. However, Indobuildco has obligations. With the obligation to hand over and donate a meeting hall and pay royalties.

Chandra said that the JCC Convention Center (Jakarta Convention Center) was also built using Pertamina’s money, not Indobuildco.

He then alluded to Indobuildco’s HGB in March and April 2023. However, it had not been handed over to the state until September 2023. In fact, within that time frame, said Chandra Hamzah, Indobuildo had made a profit.

“The rights no longer exist. The use of state assets has been commercialized since April 2023 until now. Please make your own conclusions,” said the former KPK chairman.

Another PPKGBK lawyer, Saor Siagian, requested that PT Indobuildco hand over Hotel Sultan in good faith. In addition, so that the parties trying to protect PT Indobuildco do not hinder the process of emptying the Hotel Sultan.

“We ask anyone to help in this law enforcement process, we remind you because there are still officials or anyone who tries to obstruct it for the sake of law, I think this has consequences,” he concluded.

This dispute has been tried many times. Several lawsuits have been filed several times. Starting from 2006, Pontjo Sutowo sued the state over a land dispute over the management of the Sultan Hotel by PT Indobuild. The lawsuit is related to HGB Numbers 26/gelora and 27/gelora belonging to the company, which will expire on 3 April 2023 and 3 March 2023.

Regarding the management of the Sultan Hotel, it has passed 7 trials. Indobuild has repeatedly lost at the review (PK) level. Most recently, at the 8th trial at the Jakarta Administrative Court, Indobuild’s lawsuit was again rejected. [kumparan.com/photo special]
